1. Acceptance of Terms

By accessing or using PromptPrime ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

PromptPrime provides digital products in the form of AI prompt libraries and related resources ("Products"). All Products are delivered electronically as downloadable files.

3. License Grant

Upon purchase, we grant you a non-exclusive, non-transferable, revocable license to use the Products for personal or commercial purposes, subject to these Terms:

  • You may use the prompts with any AI tool (ChatGPT, Claude, etc.)
  • You may modify and customize the prompts for your own use
  • You may use outputs generated from the prompts commercially
  • You may NOT resell, redistribute, or share the prompt files themselves
  • You may NOT claim authorship of the prompts
  • One license is valid for one individual or business entity

4. Purchases and Payment

All purchases are processed securely through Stripe. By making a purchase, you agree to:

  • Provide accurate and complete payment information
  • Pay all charges at the prices in effect when incurred
  • Be responsible for all taxes and fees

Prices are subject to change without notice. All sales are in USD unless otherwise stated.

5. Refund Policy

All sales are final once you download your prompt packs. Due to the nature of digital products, we cannot offer refunds after download. By completing your purchase, you acknowledge that:

  • You have reviewed the product description and free samples
  • You understand that downloading the product makes the sale final
  • Refunds are only available for technical issues preventing download or if the product is significantly different from the description
  • All refund requests must be made within 7 days of purchase

6. Download Limits

Each purchase includes up to 10 downloads per product. If you exceed this limit, contact us for assistance. We may reset your download count at our discretion.

7. Intellectual Property

All content on PromptPrime, including prompts, text, graphics, logos, and software, is the property of PromptPrime or its licensors and is protected by copyright and other intellectual property laws.

8. Prohibited Uses

You agree NOT to:

  • Resell, redistribute, or share the Products with others
  • Reverse engineer or attempt to extract source code
  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Transmit viruses or malicious code
  • Interfere with the security or operation of the Service
  • Attempt to gain unauthorized access to any part of the Service

9. Disclaimers

THE SERVICE AND PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

  • That the Products will meet your specific requirements
  • That AI tools will generate specific results from the prompts
  • That the Service will be uninterrupted or error-free
  • That defects will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PromptPrime SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCTS.

11. Indemnification

You agree to indemnify and hold harmless PromptPrime from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

12. Updates and Modifications

We may update Products from time to time. Customers who purchase lifetime updates will receive all future versions at no additional cost. Standard purchases include the current version only.

13. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

15. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration, except where prohibited by law.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and PromptPrime regarding the Service and supersede all prior agreements.
